These Terms and Conditions govern all purchases made through the website operated by The ViberStore Group Limited, trading as ViberStore. By placing an order on www.viberstore.ie, you agree to be bound by the terms outlined below. These terms do not affect your statutory rights as a consumer under Irish and EU law.

2. Eligibility to Purchase

To place an order through our website, you must be at least 18 years of age or have the permission of a parent or legal guardian. By submitting an order, you confirm that you are legally capable of entering into a binding contract and that the payment method used belongs to you or is authorised for your use.

We reserve the right to decline or cancel any order where we have reason to believe that the above criteria are not met, or where we suspect fraudulent activity or misuse of our platform. Additional identification may be requested for high-value purchases, and we reserve the right to verify payment details before dispatching any goods.

3. Products and Availability

ViberStore sells a range of new, second-hand, and refurbished devices, including but not limited to mobile phones and tablets. All products are subject to availability and may be withdrawn at any time without prior notice. We strive to ensure that product descriptions, specifications, and pricing are accurate; however, errors may occasionally occur. In the event of a pricing or description error, we reserve the right to correct the error and either cancel or revise your order.

In the event that a specific model, colour, or storage capacity is unavailable, a member of our team may contact you to offer an alternative. If the alternative is not acceptable to you, you will be entitled to a full refund.

Certain products sold by ViberStore may be sourced from international markets outside of Ireland or the European Union. As a result, some devices may have originally been manufactured for use in another region. This may affect manufacturer warranty eligibility, manufacturer-authorised repair options, or access to certain region-specific services.

ViberStore ensures that all products sold are fully functional for their intended use at the time of sale. Where manufacturer support is unavailable or limited due to the region of origin of a device, your warranty and after-sales support will be provided directly by ViberStore in accordance with these Terms and applicable consumer protection law.

All products sold by ViberStore are subject to standard VAT. VAT is included in the displayed price and a full VAT invoice will be provided with every order. Businesses and VAT-registered customers may reclaim VAT where applicable, in accordance with Irish tax regulations.

4. Pricing and Payment

All prices on our website are listed in Euro (EUR) and are inclusive of VAT where applicable. All products are sold under the standard VAT scheme and are eligible for VAT reclaim, where applicable. Pricing may vary based on market fluctuations and is subject to change without prior notice.

Full payment must be received and cleared before any goods are dispatched. We accept a range of secure payment methods including credit and debit cards. In certain cases, especially for high-value items, we may require photo identification and proof of address to verify the purchaser’s identity.

We reserve the right to cancel or refuse any order where pricing errors, unauthorised payment methods, suspected fraud, or misuse of our platform are identified.

5. Shipping and Delivery

We offer nationwide delivery within the Republic of Ireland. Same-day delivery is available within the Dublin area for orders placed before noon, Monday to Friday, excluding bank holidays. For orders outside of Dublin, we aim to deliver within 1–2 working days using trusted courier partners including DHL and UPS.

While we make every effort to meet these delivery timelines, delays may occasionally occur due to third-party logistics, courier issues, adverse weather, public holidays, or peak seasonal volumes. We are not liable for delays beyond our reasonable control, but we will do our best to keep you informed of any issues.

All deliveries must be signed for by the person who placed the order, unless otherwise agreed in advance. For security reasons, we do not deliver to third-party addresses such as neighbours or workplaces unless specifically arranged in advance. If no one is available to accept the delivery, the item may be returned to our warehouse and a redelivery charge may apply.

6. Returns and Cancellations

If you change your mind after purchasing online, you have the legal right to cancel your order within 14 days of receiving your goods, in accordance with applicable consumer protection law. To exercise this right, you must notify us in writing by email within that 14-day period. You then have a further 14 days to return the goods.

ViberStore offers a 30-day return policy with free returns on eligible products within Ireland. This means that, regardless of the reason, including change of mind, we will cover the cost of return shipping within Ireland if the return is initiated within 30 days of receiving your item and the product meets our return conditions.

Items must be returned in the same condition in which they were received, unused, undamaged, and in their original packaging with all accessories included. Returns that are incomplete, damaged, missing accessories, or show signs of use beyond what is necessary to inspect the goods may be subject to a partial refund or rejection, where permitted by law.

Once your return has been approved, a prepaid return label will be issued. Refunds will be processed to the original payment method within 3–5 working days of receiving and inspecting the returned goods.

We will refund the standard delivery cost where required by law or where the return is due to an error on our part, such as a faulty, incorrect, or misdescribed item.

7. Warranty

All devices sold by ViberStore come with a warranty of either 6 or 12 months, depending on the product type. This warranty covers manufacturing defects, software faults, and technical issues that are not caused by accidental damage, misuse, neglect, liquid damage, or unauthorised repair.

Devices sold by ViberStore may originate from a range of international markets, including but not limited to the European Union, United Kingdom, Asia-Pacific regions, and other global territories. As a result, certain devices may not be eligible for manufacturer warranty, authorised manufacturer repair services, or manufacturer support within Ireland or the European Union.

By purchasing from ViberStore, the customer acknowledges that any manufacturer warranty, where applicable, may be limited by the region of origin of the device. ViberStore does not guarantee access to manufacturer-supported repairs, authorised service centres, or region-specific manufacturer services within Ireland or the European Union.

Your warranty and after-sales support are provided directly by ViberStore. Where a fault arises, customers must contact ViberStore directly to initiate a warranty claim. We will assess the issue and provide an appropriate resolution, which may include repair, replacement, or refund, depending on the nature of the fault and in accordance with applicable consumer protection law.

The warranty does not cover:

  • Accidental or physical damage
  • Cracked screens, liquid damage, or cosmetic wear and tear
  • Issues caused by misuse, neglect, or improper handling
  • Issues caused by third-party software, accessories, chargers, or modifications
  • Repairs or modifications carried out by any party other than ViberStore
  • Normal battery wear outside the battery warranty period

Batteries are covered for a period of 90 days from the date of purchase.

Warranty claims must be submitted with valid proof of purchase. Turnaround time for repairs is typically 48 hours from receipt of the item, although this may vary depending on the nature of the issue, parts availability, and inspection requirements.

Nothing in this section limits or excludes your statutory rights under Irish and EU consumer protection law, including your rights where goods are faulty, not as described, or not fit for their intended purpose.

8. Competitions and Promotions

By entering a ViberStore competition, you agree to be bound by the terms of that competition and our general terms. Winners will be selected at random and announced via our official platforms. Once announced, winners have 30 days to claim their prize.

All prizes are non-transferable and cannot be exchanged for cash. ViberStore reserves the right to feature the winner’s name or image, with consent, on our platforms to promote transparency. Proof of identity may be required when claiming a prize.

Competitions may be cross-promoted across Facebook, Instagram, or other platforms, and entries may be pooled to ensure fairness. Any misuse or manipulation of the competition process will result in disqualification.

9. Limitation of Liability

Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability which cannot be excluded under applicable law.

To the fullest extent permitted by law, ViberStore shall not be liable for any indirect, incidental, or consequential loss arising from your use of our website or products. Our total liability to you in any circumstance will be limited to the amount paid by you for the product in question, except where the law provides otherwise.

We shall not be held liable for any failure or delay in our performance where such failure results from any cause beyond our reasonable control, including but not limited to natural disasters, strikes, courier disruption, supply chain delays, delivery interruptions, payment processing issues, or telecommunications failures.

10. Dispute Resolution and Governing Law

If you are unhappy with your purchase or the service you received, we encourage you to contact our team directly at returns@viberstore.com so we can resolve the issue promptly.

If a dispute arises and cannot be resolved through direct communication, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. This service helps consumers and retailers settle disputes out of court.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Ireland. Any disputes shall be subject to the jurisdiction of the Irish courts, without affecting any mandatory consumer rights that may apply in your country of residence.

11. General Provisions

We may update these Terms and Conditions from time to time to reflect changes in our services, business operations, legal obligations, or customer policies. The latest version will always be available on our website. Continued use of our website and placing orders after any update indicates your acceptance of the updated terms.

No delay or failure by us in exercising any of our rights under these Terms and Conditions shall impair our rights or be construed as a waiver. If any part of these terms is deemed invalid or unenforceable, all other provisions shall remain in full force.

You may not transfer any of your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations where reasonably necessary for business, legal, or operational purposes, provided this does not reduce your statutory rights.
